These Terms and Conditions (“Agreement”) govern your use of Next Level Gardening and the Planting Calculator. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, you must not access or use our services.

1. Use of Services

• You must be at least 18 years old or have parental consent to use our services.
• You agree to use the platform in compliance with all applicable laws and regulations.
• Unauthorized use, including hacking, scraping, or reverse engineering, is strictly prohibited.

2. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• We reserve the right to suspend or terminate accounts that violate these terms.
• Any attempt to impersonate another user or gain unauthorized access will result in immediate account termination.

3. Payments and Subscriptions

• Subscriptions and payments are processed through Memberstack and Stripe.
• All payments are final. We do not issue refunds under any circumstances.
• Users are responsible for canceling their subscriptions before the next billing cycle.
• We reserve the right to change pricing at any time, with prior notice to active subscribers.

4. Community Guidelines

• Users must conduct themselves respectfully in the Circle community.
• Hate speech, harassment, or abusive behavior will result in immediate account suspension.
• Spamming, advertising, or self-promotion without permission is prohibited.

5. Intellectual Property

• All content on the Website, including the Planting Calculator, is owned by Next Level Gardening and protected by copyright laws.
• You may not copy, modify, or distribute any Website content without prior written permission.
• Unauthorized use of our trademarks, logos, or brand elements is strictly prohibited.

6. Disclaimers and Limitation of Liability

• The services are provided “as is” without warranties of any kind, express or implied.
• We do not guarantee the accuracy, reliability, or availability of the Planting Calculator or any other service.
• To the fullest extent permitted by law, Next Level Gardening shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the services.
• You agree to indemnify and hold harmless Next Level Gardening from any claims arising from your use of our services.

7. Termination of Service

We reserve the right to suspend or terminate your account without notice if:

• You violate any part of this Agreement.
• Your actions pose a risk to the security or integrity of our services.
• We are required to do so by law.

8. Governing Law and Dispute Resolution

• This Agreement shall be governed by the laws of the State of California, without regard to conflict of law principles.
• Any disputes arising under this Agreement shall be resolved through binding arbitration in California.
• You waive any right to participate in a class-action lawsuit against us.

9. Changes to These Terms

We may update these Terms periodically. Continued use of our services constitutes acceptance of the updated Terms.
